Cumulation of procedures is now authorized for unaccompanied foreign minors in Belgium

As from 26 March 2015, unaccompanied foreign minors can also qualify for the special protection status when other protection, admission or residence procedures are ongoing.

The Law of 26 February 2015 modified Article 61/15 the Immigration Law, providing that: "whether or not another procedure is ongoing relating to protection, authorization or admission to stay or settlement, the guardian can, for the ward,  introduce, to the Minister or his delegate, an application to be authorized to stay based on this chapter".

In this way the protection of unaccompanied foreign minors is guaranteed. From the parliamentary work, it appears that the provisison concerns in practice around 1400 minors.

The above-mentioned Law was published in the Belgian Official Gazette on 16 March 2015 and came into force today, 26 March 2015.
