2 Laws modifying the Asylum Procedure were published today in the Belgian Official Gazette

Today, two Laws which modify the asylum procedure (and the reception & public welfare centers laws) were published in the Belgian Official Gazette. The Royal Decree from 1981 and the Royal Decrees regulating the procedure before the IO and CGRS were also modified and published.

The texts concerned include the following provisions, inter alia:

  1. Attribution of jurisdiction to the Commissionner General for Refugees and Stateless Persons (CGRS) to review "new elements" in case of multiple applications (and adoption of a new definition of "new elements" rather focused on content than on timeline)
     
  2. Implementation of the concept of "first country of asylum" according to the Procedures Directive
     
  3. Issuance of a single (extendable) "order to leave the territory" after a negative decision of the CGRS
     
  4. Legal obligation for applicants to complete the CGRS questionnaire when registrating their applications in the Immigration Office (IO)
     
  5. Legal basis for a material support distribution plan
     
  6. Implementation of some articles of the recast of the Qualification Directive
     
  7. Amendment of certain modalities of the procedure before the Aliens Litigation Council
